1. Acceptance of Terms
By accessing or using FB Postiz, you represent that:

You have the legal capacity to enter into a binding contract
You will comply with all applicable laws and third-party platform policies (Facebook, Instagram, Twitter, etc.)
All information you provide is accurate, current, and complete
If you disagree with any part of these Terms, you must immediately cease using the Platform.
2. Account Registration and Security
To use FB Postiz, you must create an account by providing:
Maintaining the confidentiality of your account credentials
All activities that occur under your account, whether authorized or not
Notifying us immediately of any unauthorized access or security breach

3. Permitted Use
You may use FB Postiz to:
Schedule and automate social media posts across connected platforms
Upload, store, and organize media files via 9Drive integration
Generate AI-powered captions, images, and content recommendations
Analyze social media performance and engagement metrics
Manage multiple social media accounts from a unified dashboard
4. Prohibited Activities
You agree NOT to:
Violate Third-Party Policies: Break Facebook, Instagram, Twitter, LinkedIn, TikTok, YouTube, or other platform terms of service
Post Illegal Content: Share content that violates laws (copyright infringement, hate speech, threats, harassment, child exploitation)
Spam or Abuse: Send unsolicited messages, automate fake engagement, manipulate algorithms, or perform mass follow/unfollow actions
Scrape or Reverse Engineer: Extract data from the Platform, decompile code, or attempt to bypass security measures
Share Accounts: Allow multiple users to access a single account without a valid multi-user license
Resell Services: Redistribute or resell FB Postiz access without explicit written permission
Attack Infrastructure: Launch DDoS attacks, inject malicious code, or attempt unauthorized access to our systems
Violations may result in immediate account suspension or termination without refund.
5. Social Media Integration
FB Postiz integrates with third-party platforms via official APIs. By connecting a social media account:
You grant us permission to post content, retrieve analytics, and manage connections on your behalf
You remain solely responsible for all content published through our Platform
You acknowledge that third-party platforms may suspend or ban your account for policy violations, independent of FB Postiz
We are NOT responsible for changes to third-party APIs, rate limits, or platform policy updates
6. Intellectual Property
Your Content: You retain all ownership rights to content you create, upload, or schedule through FB Postiz. By using our Platform, you grant us a limited, non-exclusive, worldwide license to store, process, and transmit your content solely to provide the Service.
Our Platform: FB Postiz source code, UI design, trademarks, logos, and proprietary technology are protected by copyright, trademark, and other intellectual property laws. You may NOT copy, modify, or redistribute any part of our Platform without written consent.
AI-Generated Content: Content generated by our AI tools (captions, images, videos) is provided "as-is". You are responsible for reviewing, editing, and ensuring AI-generated content complies with third-party platform policies before publishing.
7. Fees and Payment
FB Postiz offers free and paid subscription tiers:
Free Tier: Limited features, storage, and scheduled posts (subject to change)
Paid Subscriptions: Monthly or annual billing via Stripe, PayPal, or other payment processors
Refunds: All sales are final. No refunds for unused subscription time, except as required by law
Price Changes: We reserve the right to modify pricing with 30 days' advance notice
Failure to pay subscription fees may result in account suspension or downgrade to the free tier.
8. Service Availability and Uptime
We strive to maintain 99.9% uptime, but we do NOT guarantee uninterrupted access. The Platform may be unavailable due to:
Scheduled maintenance (announced in advance when possible)
Third-party API outages (Facebook, Twitter, AWS, Cloudflare, etc.)
DDoS attacks, security incidents, or force majeure events
We are NOT liable for missed posts, lost engagement, or business losses due to service downtime.
9. Data Backup and Loss
While we perform automated daily backups, you are responsible for maintaining your own copies of:
Scheduled post drafts, captions, and media files
Social media API keys and integration credentials

We are NOT responsible for data loss due to accidental deletion, account termination, or platform errors.
10. Disclaimer of Warranties
FB POSTIZ IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
Warranties of merchantability, fitness for a particular purpose, or non-infringement
Accuracy, reliability, or completeness of AI-generated content
Compatibility with third-party platforms or devices
Security against unauthorized access, malware, or data breaches
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FB POSTIZ AND ITS AFFILIATES SHALL NOT BE LIABLE FOR:
Indirect, incidental, consequential, or punitive damages
Lost profits, revenue, data, or business opportunities
Account suspensions or bans by third-party platforms
Damages exceeding the total fees paid to us in the 12 months prior to the claim
12. Indemnification
You agree to indemnify, defend, and hold harmless FB Postiz and its officers, directors, employees, and affiliates from any claims, liabilities, damages, or expenses (including legal fees) arising from:
Your violation of these Terms or applicable laws
Content you post through the Platform
Unauthorized access to your account due to negligence
Third-party claims related to your use of the Service
13. Termination
We may suspend or terminate your account immediately, without notice, if you:
Violate these Terms or third-party platform policies
Engage in fraudulent, abusive, or illegal activities
Fail to pay subscription fees
You may terminate your account at any time by contacting support. Upon termination:
Your scheduled posts will be canceled
Social media integrations will be revoked
Account data will be deleted within 30 days (see Privacy Policy)
14. Modifications to Terms
We may update these Terms from time to time to reflect changes in:
Legal requirements or regulatory compliance (GDPR, CCPA, etc.)
Platform features, pricing, or service offerings
Third-party API changes or integration updates
Security policies or operational procedures
Notification Process:
Changes will be posted on this page with an updated "Last Updated" date
Material changes will be communicated via email at least 30 days in advance
Continued use after the effective date constitutes acceptance of revised Terms
If you disagree with changes, you must stop using the Platform and may request a pro-rated refund for unused subscription time (if applicable)
15. Governing Law and Dispute Resolution

18. Feedback and Suggestions
If you provide feedback, suggestions, or ideas about the Platform ("Feedback"), you grant us a perpetual, irrevocable, royalty-free, worldwide license to use, modify, and commercialize the Feedback without compensation or attribution. We are NOT obligated to implement any Feedback.
19. Third-Party Links and Services
The Platform may contain links to third-party websites, services, or integrations (social media platforms, payment processors, analytics tools). We do NOT control or endorse these third parties and are NOT responsible for:
Content, privacy practices, or security of external websites
Transactions, subscriptions, or purchases made through third-party services
Changes to third-party APIs, rate limits, or pricing
Your use of third-party services is governed by their respective Terms of Service and Privacy Policies.
20. Severability
If any provision of these Terms is found invalid, unlawful, or unenforceable by a court or arbitrator, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the original intent.
21. No Waiver
Our failure to enforce any provision of these Terms shall NOT constitute a waiver of that provision or our right to enforce it in the future. No waiver shall be effective unless made in writing and signed by an authorized representative of FB Postiz.
22. Assignment
You may NOT assign or transfer these Terms or your account to any third party without our prior written consent. We may assign our rights and obligations under these Terms to any successor entity in connection with a merger, acquisition, or sale of assets.

Provisions that by their nature should survive termination shall remain in effect, including but not limited to: Sections 6 (Intellectual Property), 10 (Disclaimer of Warranties), 11 (Limitation of Liability), 12 (Indemnification), 15 (Governing Law), and 20 (Severability).

These Terms, together with our Privacy Policy, constitute the entire agreement between you and FB Postiz regarding use of the Platform. These Terms supersede all prior agreements, understandings, negotiations, or communications (written or oral) relating to the subject matter herein.
